Acceptable Use Policy

By using the Service, Customer acknowledges that Customer and each User (defined below) will abide by the AUP. Customer is responsible for violations of the AUP by any User. A User shall mean anyone that Customer has provided access to the Service through Customer’s account and Customer and each User shall be collectively referred to as “Users”.
Prohibited Use. Users are prohibited from willfully facilitating the violation of any part of this AUP or another provider’s AUP, including, but not limited to transmitting, distributing, or otherwise making available any product or service that violates this AUP.

 

Inappropriate/Harmful Content
Customer shall not use the Verve Network and Services to transmit, distribute or store material that is inappropriate, or material that is obscene (including child pornography), defamatory, libelous, threatening, abusive, hateful, or excessively violent.Verve does not acquire any ownership interest in or right to the information Customer transmit through the Service or information stored on CPE. Customer shall not knowingly use the Services to transmit, distribute or store material that may be harmful to or interfere with the Services or any third party’s networks, systems, services, or web sites. Such prohibited harmful content includes, but is not limited to, viruses, worms, or Trojan horses.

 

Intellectual Property
Material accessible through the Verve Network and Services may be subject to protection under privacy, publicity, or other personal rights and Intellectual Property rights, including but not limited to, copyrights and laws protecting patents, trademarks, trade secrets or other proprietary information. Customer shall not use the Services to transmit data that infringes, dilutes misappropriate, or otherwise violate any such rights. If Customer uses a domain name in connection with any of the Verve Network and Services, Customer’s domain name must not use that domain name in violation of the trademark, service mark, or other rights of any third party.

Fraudulent/Misleading Content. Customer shall not use the Services to transmit or distribute material containing fraudulent offers for goods or services, or any advertising or promotional materials that contain false, deceptive, or misleading statements, claims, or representations. In addition, Customer is prohibited from submitting any false or inaccurate data on any order form, contract or online application, including the fraudulent use of credit cards.

 

Email and Unsolicited Messages
Customer shall not use the Services to transmit unsolicited e-mail messages, including, without limitation, unsolicited bulk email, where such emails could reasonably be expected to provoke complaints (“spam”). Further, Customer is prohibited from using the service of another provider to send spam to promote a site hosted on or connected to the Verve Network . In addition, Customer shall not use the Services in order to (a) send e-mail messages which are excessive and/or intended to harass or annoy others, (b) continue to send e-mail messages to a recipient that has indicated that he/she does not wish to receive them, (c) send e-mail with forged TCP/IP packet header information, (d) send malicious e-mail, including, without limitation, “mailbombing”, (e) send or receive e-mail messages in a manner that violates the use policies of any other Internet service provider, or (f) use an e-mail box exclusively as a storage space for data.

 

Inappropriate Actions
Customer shall not use the Services to conduct activities that may be harmful to or interfere with the Services or any third party’s networks, systems, services, or Web sites, including, but not limited to, flooding, mail bombing, or denial of service attacks. Customer is prohibited from violating or attempting to violate the security of the Verve Network and Services or the computers, accounts, or networks of another party. Customer is also prohibited from any activity considered a precursor to attempted security violations, including, but not limited to, any form of unauthorized scanning, probing, or other testing or information gathering activity. Inappropriate activity may result in civil or criminal liability. Verve will investigate such activity, and may involve and cooperate with law enforcement authorities in prosecuting customers involved in such activity.

 

Unauthorized Access/Interference
Users may not attempt to gain unauthorized access to, or attempt to interfere with or compromise the normal functioning, operation, or security of any network, system, computing facility, equipment, data, or information. A User may not use the Service to engage in any activities that may interfere with the ability of others to access or use the Service or the Internet. A User may not use the Service to monitor any data, information, or communications on any network or system without authorization. A User may not attempt to gain unauthorized access to the user accounts or passwords of other users.

 

UCE/Spamming/Mailbombing
Users may not use the Service to transmit excessive volumes of unsolicited commercial email messages or deliberately send excessively large attachments to one recipient. Any unsolicited commercial email messages or a series of unsolicited commercial email messages or large attachments sent to one recipient constitutes Unsolicited Commercial Email “UCE” and is prohibited. In addition, “spamming” or “mailbombing” is also prohibited. Use of the service of another provider to send UCE, spam or mailbombs, to promote a site hosted on or connected to the Verve network, is similarly prohibited. Likewise, you may not use the Service to collect responses from mass unsolicited email messages

 

Spoofing/Fraud
Users may not attempt to send email messages or transmit any electronic communications using a name or address of someone other than the User for purposes of deception. Any attempt to impersonate someone else by altering a source IP address information or by using forged headers or other identifying information is prohibited. Any attempt to fraudulently conceal, forge, or otherwise falsify a User’s identity in connection with use of the Service is prohibited.

 

Email Relay
Any use of another party’s electronic mail server by Users to relay email without express permission from such other party is prohibited.

 

Illegal Activity
Users agree to use the Service only for lawful purposes. Use of the Service for transmission, distribution, retrieval, or storage of any information, data, or other material in violation of any applicable law or regulation (including, where applicable any tariff or treaty) is prohibited. This includes, without limitation, the use or transmission of any data or material protected by copyright, trademark, trade secret, patent, or other intellectual property right without proper authorization and the transmission of any material that constitutes an illegal threat, violates export control laws, or is obscene, defamatory, or otherwise unlawful.

 

Other Prohibited Activities
The following activities are also prohibited:
• Attempting to intercept, redirect, or otherwise interfere with communications intended for others.
• Intentionally transmitting files containing a computer virus or corrupted data.
